Pregnancy Justice Senior Staff Attorney Amber Khan presents on the Child Abuse Prevention and Treatment Act (CAPTA) to a New York State Department of Health workgroup

In December 2018, Pregnancy Justice Senior Staff Attorney Amber Khan delivered a presentation to the AIDS Institute’s state-wide Women Who Use Drugs Workgroup, part of the New York State Department of Health, on the federal Child Abuse Prevention and Treatment Act (CAPTA) and its connection to pregnancy and drug use.

This talk included practical information about CAPTA and reporting, making it clear that CAPTA does not require medical providers to report all substance-exposed newborns to child welfare authorities as suspected cases of child abuse or neglect, as well as offering recommendations for how hospitals and other agencies can meet the requirements of CAPTA and respect their patients.

Read Pregnancy Justice’s Fact Sheet “Understanding CAPTA and State Obligations” for additional information on CAPTA and what it requires.
